TERMS OF BUSINESS AND USE
ZooZoom.eu
1. Operator
The internet portal www.zoozoom.eu is operated by:
WHF s. r. o.
(hereinafter referred to as the “Operator”).
The Operator provides users of the ZooZoom.eu portal with free and paid classified advertising services.
These Terms of Business and Use govern the conditions for using the ZooZoom.eu portal, as well as the rights and obligations of the Operator and its users.
The Operator’s full identification and contact details are available on the ZooZoom.eu portal.
2. Nature of the Service
ZooZoom.eu is a classified advertising portal primarily focused on:
- sale of animals,
- animals offered free of charge,
- animal adoptions,
- pet and animal supplies,
- animal-related services.
The portal primarily serves to facilitate contact between advertisers and interested parties.
The Operator is not a party to any purchase, donation or other legal relationship established between users of the portal and is not responsible for the fulfilment of obligations between users.
3. Registration and User Account
Users may use the services of the portal to the extent currently made available by the portal.
Users may create a user account.
Users are required to provide truthful, complete and up-to-date information.
Users are responsible for protecting their login credentials and for activities carried out through their user accounts.
4. Advertising Rules
In particular, it is prohibited to advertise:
- dead animals, meat or animal parts,
- protected species or animals kept illegally,
- animals obtained through illegal activities,
- goods or services whose offering is contrary to applicable law,
- weapons and illegal items,
- financial services and loans,
- erotic or otherwise inappropriate content,
- get-rich-quick offers,
- duplicate or identical advertisements,
- advertisements containing excessive misleading or disruptive promotional elements.
An advertisement must:
- truthfully and clearly describe the animal, goods or service being offered,
- contain truthful information,
- be placed in the appropriate category,
- comply with applicable laws and regulations.
The Operator is entitled to edit, hide, move to another category or remove an advertisement that violates these Terms or applicable law.
5. Responsibility for Advertisement Content
The advertiser is fully responsible for the content of the advertisement.
Advertisers may not use the portal to infringe the rights of third parties, including copyrights, trademarks or personality rights.
In the event of a breach of these Terms, the Operator may remove an advertisement or restrict or block the user’s account.
6. Photographs
Advertisers may only upload photographs:
- to which they hold the necessary rights, or
- which they are otherwise authorised to use and publish.
By uploading a photograph, the advertiser grants the Operator a free, non-exclusive licence to use the photograph to the extent necessary to display and promote the relevant advertisement on the ZooZoom.eu portal.
7. Advertisement Publication Period
An advertisement is normally published for 60 days, unless otherwise stated when creating the advertisement or within the relevant category.
After this period expires, the advertisement may be automatically deactivated, hidden or removed according to the current settings of the portal.
Featuring an advertisement does not in itself extend the overall publication period of the advertisement.
8. Paid Service – Featured Advertisement
The Operator allows users to purchase paid promotion of a specific advertisement in the form of a Featured Advertisement (TOP) service.
The Featured Advertisement service is a paid service intended to increase the visibility of an advertisement on the ZooZoom.eu portal.
During the Featured period, the advertisement may in particular:
- be displayed before standard advertisements,
- be highlighted or marked as TOP,
- be displayed in a preferential position in listings or search results.
The Featured Advertisement service does not guarantee any specific number of views, enquiries, interested parties or a successful sale.
Price and Duration
The price of the Featured Advertisement service is:
€3 for 7 days.
The price displayed when placing the order is the final price of the service.
The 7-day Featured period begins when the service is activated following successful confirmation of payment.
After 7 days, the Featured status automatically expires and the advertisement will continue to be displayed as a standard advertisement, provided that its overall publication period has not expired and it has not been removed for another reason.
The Featured Advertisement service does not renew automatically.
The Operator may change the price of the Featured Advertisement service in the future. Any price change will not affect services that have already been ordered and paid for.
9. Ordering and Payment for the Featured Advertisement Service
The Featured Advertisement service may be purchased for advertisements for which this feature is available.
Before making payment, the user is informed of:
- the price of the service,
- the duration of the service,
- the essential features of the Featured Advertisement service,
- these Terms of Business and Use.
Payment is made online via Stripe.
Payment card details are processed by the payment service provider. The Operator may not have access to the user’s complete payment card details.
The order for the Featured Advertisement service becomes final upon successful completion of payment.
The Operator will provide the user with confirmation of the ordered paid service, generally by email.
10. Immediate Activation of the Featured Advertisement Service
The Featured Advertisement service is activated immediately following successful payment.
If the user is acting as a consumer, before making payment the user expressly requests that the provision of the service begin before the expiry of the statutory withdrawal period.
The consumer also confirms that they have been informed that, once the service has been fully provided, they lose the right to withdraw.
If the consumer exercises the right of withdrawal after the provision of the service has begun at their express request but before the service has been fully provided, the consumer’s rights and obligations shall be governed by the applicable laws of the Slovak Republic.
11. Removal of an Advertisement During the Featured Period
If the user voluntarily removes or deactivates their advertisement during the Featured period, the Featured Advertisement service thereby ends.
If an advertisement is removed by the Operator due to a breach of these Terms of Business and Use or applicable law, the user shall not be entitled to reimbursement for the unused portion of the Featured period unless mandatory law provides otherwise.
If the Featured Advertisement service cannot be provided or does not function properly for reasons attributable to the Operator, the user is entitled to an appropriate remedy depending on the circumstances, in particular:
- restoration of the Featured service,
- extension of the Featured period,
- or an appropriate refund.
12. Complaints Regarding Paid Services
If the Featured Advertisement service is not activated following successful payment, does not function properly, or ceases to function due to circumstances attributable to the Operator, the user may submit a complaint.
When submitting a complaint, the user should provide, in particular:
- information identifying their user account or advertisement,
- the date of payment,
- a description of the problem.
The Operator will handle complaints in accordance with applicable law.
13. Consumer Right of Withdrawal
If the user is acting as a consumer, they have the right to withdraw from a paid service ordered at a distance under the conditions established by applicable law.
For the provision of a service, the statutory withdrawal period is generally 14 days from the date on which the service is ordered.
If the consumer has expressly requested that the Featured Advertisement service begin before the expiry of this period, the legal provisions applicable to services commenced at the consumer’s express request shall apply.
The consumer loses the right of withdrawal once the service has been fully provided, provided that the service began with the consumer’s prior express consent and the consumer was duly informed that the right of withdrawal would be lost once the service had been fully provided.
The consumer may exercise the right of withdrawal in the manner provided for by applicable law and using the Operator’s contact details.
14. Ranking of Advertisements
Standard advertisements are ranked according to the rules currently applied by the portal, in particular according to the date on which they were added or updated.
Featured advertisements may be displayed before standard advertisements during the Featured period.
Users may change the displayed results using the available filters and sorting options.
15. Operator’s Liability
The Operator is not responsible, in particular, for:
- the accuracy of information provided by advertisers,
- the quality, origin or health condition of animals offered,
- communication or transactions between users,
- fulfilment of obligations between an advertiser and an interested party.
The Featured Advertisement service only provides preferential display of an advertisement and does not guarantee a commercial result or successful sale.
Nothing in this provision affects consumer rights that cannot be excluded or restricted under applicable law.
16. Personal Data Protection
The processing of personal data is governed by the separate Privacy Policy (GDPR).
In connection with payments, personal and payment data may also be processed by Stripe in accordance with its own terms and privacy policy.
17. Account Restriction or Blocking
The Operator may restrict or block a user account, in particular in the event of:
- repeated breaches of these Terms of Business and Use,
- fraudulent or unlawful conduct,
- misuse of the portal,
- conduct that causes harm to the portal or its users.
18. Amendments to the Terms of Business and Use
The Operator may reasonably amend these Terms of Business and Use, in particular due to changes in applicable law, the functionality of the portal or the scope of services provided.
Changes to these Terms will not affect services that have already been ordered and paid for, unless otherwise required by applicable law.
The current version of the Terms of Business and Use is always available on the ZooZoom.eu portal.
19. Final Provisions
Legal relations between the Operator and the user are governed by the laws of the Slovak Republic.
If the user is acting as a consumer, these Terms of Business and Use apply only to the extent that they do not restrict any rights granted to the consumer by mandatory applicable law.
These Terms of Business and Use enter into force on the date of their publication on the ZooZoom.eu portal.
